引渡引渡extradition一国应他国的请求，将在其境内被该外国指控为犯罪的或已判刑的人移交给该外国审判或处罚。一般情况下，可以提出引渡请求的国家有：罪犯国籍所属国、犯罪行为地国、受害国即犯罪结果发生地国。当有数个国家为同一罪行或不同罪行请求引渡同一人时，原则上被请求国有权决定接受哪一个国家的请求。1933年美洲国家间《引渡公约》规定：如有几个国家为同一罪行请求引渡时，犯罪行为地国有优先权；如罪犯有几项罪行，则依被请求国法律罪刑最重的犯罪地国有优先权。除条约另有规定外，引渡请求应通过外交途径提出。请求引渡的国家有义务说明请求引渡的理由，包括提供罪犯的罪行细节。引渡的对象可以是请求国的本国国民、第三国国民或被请求国国民。通常各国都拒绝引渡本国国民，只有英、美等国有少数相反的案例。构成引渡的理由，一般是普通刑事犯罪，而且必须是请求引渡国家和被请求引渡国家双方都认为是犯罪的行为或者是引渡条约中所规定的罪行。政治犯一般不引渡（见庇护）。宗教罪犯或违反军法的军事罪犯亦不引渡。第二次世界大战后战争罪不视为政治罪而可以引渡。灭绝种族罪和种族隔离罪也不视为政治罪。引渡是一种国家行为，一国是否接受他国的引渡请求，除非负有条约义务，由被请求国政府自行决定。在实践中，有些国家认为，只有负有引渡的条约义务的国家间方可提出引渡要求，多数国家则无此种限制。使缔约国负有引渡义务的条约有专门的引渡条约和包含有引渡条款的条约。大量的引渡条约是双边的。
